After much product research, including glowing reviews on Epinions(at the time), and Kevin Dyevich’s promise of money back guarantee, my husband and I purchased the SAM mattress in the fall of 2002.
As soon as we removed the mattress from the 3 boxes and assembled the unit, it became obvious to us that the product pictured on the Web site did not look like the mattress we received. The Web site shows a view of the patented air valves covering the entire mattress width, when in fact these air valves only fit into a box-like space(with foam around the perimeter)and only covered 3/4 of the entire space. The foam surrounding the bed does not support the body and one actually looses valuable surface space to sleep, because it sags and is very soft. Although our mattress was a King size, the effective mattress size turned out to be more like a full size with my husband and myself not having enough room to sleep.
Now in addition to the deceptive image and effective size of the mattress, the mattress did not work properly. The dial on my side of the bed did not work and after 1 week of painful, restless sleep, we decided to return the mattress. I called Comfort Direct to get the return authorization number and was instructed that only Kevin Dyevich could give this authorization. I left a message with my request, but he did not return my call. I did finally reach him the next day, but he told me that I had to send a letter in writing explaining the reason for my return before he would give me a return authorization. This seemed very odd to me, but of course I had to comply if I was to see my money. After several weeks with no response, I was told by Mr. Dyevich that he would not honor the return for a refund. We could only exchange the mattress for another one of their products. We would not agree to this, but wanted him to honor his “money back guarantee” policy. I immediately contacted the bank which the credit card was issued to stop payment.
This dispute has been going on now for over 6 months with no resolution. I recently found out that Kevin Dyevich can string this out for many more months. I finally had enough of his games and decided to lodge complaints to: NJ State Attorney General Office, NJ Division of Consumer Affairs and the ICC. There is no resolution yet.
Future consumers, please listen to these negative reviews. They are all true!!! Don’t let our problems become yours as well. I have never before filed a complaint against anyone, but this company and Kevin Dyevich deserve to have the book thrown at them for deceptive and fraudulent practices. I hope the Attorney General’s Office takes them to court. They deserve to pay for their crimes. Who knows how many other victims there are!!!!
